nicesummary from Spin of how motorists "fail to see" (or at least fail to notice) bikers (post #20, 5th down). It's actually in a thread about failing to notice a bicycle, but exactly the same issues. The thread also includes some good links along the same lines if you wish to understand better how motorists can unwittingly be in danger of taking bikers out.

In summary I'd just say that it takes 2 to have an accident ; and as we're the ones who will come out second, it's up to us to avoid them, regardless of whose right of way it was.
